By accessing or using UtsavHub (nineonline.online/festive), you agree to be bound by these Terms of Service. If you do not agree to these terms, please discontinue use of the portal.
2. Permitted Use of Creative Utilities
The greeting card maker, romantic message templates, and calendar countdowns are provided free for personal, non-commercial festive use. You may download, share, and post generated greeting cards to personal social networks without royalty fees.
3. Directory & Discovery Services
Listing of third-party service providers (such as painters, electricians, cleaning pros, florists, sweets shops, and transport services) does not constitute an endorsement, employment relationship, agency, or performance guarantee. You contract directly with service providers at your own discretion and risk.
4. Mandatory User Indemnification & Hold Harmless Clause
BY ACCESSING OR USING UTSAVHUB, OR CLICKING ANY THIRD-PARTY OR COMPETITOR LINK, YOU UNCONDITIONALLY AGREE TO DEFEND, INDEMNIFY, AND HOLD HARMLESS UTSAVHUB, NINEONLINE NETWORK, ITS OWNERS, OPERATORS, EMPLOYEES, AND AFFILIATES FROM AND AGAINST ANY AND ALL CLAIMS, LIABILITIES, LOSSES, DAMAGES, COSTS, AND EXPENSES (INCLUDING LEGAL FEES) ARISING OUT OF OR IN CONNECTION WITH:
- Your use of or reliance on any services, contractors, or retailers linked from this portal;
- Any dispute, injury, property damage, payment failure, or service deficiency caused by external third-party contractors;
- Any greeting cards, customized wish messages, or images created and distributed by you using our creative tools;
- Your violation of any applicable local, state, or national laws or third-party intellectual property rights.
5. Nominative Fair Use, Copyright Fair Dealing & Intermediary Safe Harbor
All brand trademarks (including Urban Company, Asian Paints, Justdial, WedMeGood, Amazon, Flipkart, Canva, Adobe, Greetings Island, 123Greetings, Fotor, Smilebox, PhotoADKing, DesiEVite, etc.) belong strictly to their respective owners. Their mention on this platform is purely nominative under Section 30 of the Trade Marks Act 1999 (India) for comparative identification and outbound directory routing.
UtsavHub operates as an intermediary and directory search engine under Section 79 of the Information Technology Act 2000 (India) and Title II of the Digital Millennium Copyright Act (17 U.S.C. § 512). Any quotation, editorial summary, or informational reference is strictly protected under the fair dealing provisions of Section 52 of the Indian Copyright Act 1957.
All interactive cards, AI-assisted visuals, and procedural rendering engines developed on this site are original proprietary creations or public domain/royalty-free assets. No copyrighted graphics, protected character models, or proprietary vector files from third parties are hosted, copied, or resold on our servers.
6. Notice & Takedown Procedure (DMCA / Rule 3 IT Rules 2021)
If you are a copyright owner or authorized representative and believe any content or link on UtsavHub infringes your intellectual property rights, please contact our designated grievance desk at legal@nineonline.online with valid proof of ownership, exact URLs, and identification of the infringed work. Valid notifications are processed within statutory timelines pursuant to the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.
7. Modifications & Governing Law
We reserve the right to update these terms at any time. These terms shall be governed by and construed in accordance with the laws of India, subject to the exclusive jurisdiction of competent courts in India.
